<비트코인 현물 ETF 자본시장법 위반>

 

금융위는 비트코인 현물 ETF 발행이나 해외 비트코인 현물 ETF를 중개하는 것은 기존 정부 입장과 자본시장법에 위배될 소지가 있다고 2024년 1월 15일 밝혔다. 미국은 현물 ETF 거래를 승인했으나 국내에는 적용하기 어렵다는 입장이다. 금융위는 "이 문제는 금융시장의 안정성과 금융회사 건전성, 투자자 보호와 직결됐다"며 "이를 면밀히 살펴보고 있다"고 강조했다. 다만 해외 비트코인 선물 ETF에 대해서는 규제할 계획이 없다고 밝혔다. 금융위는 "해외 비트코인 선물 ETF는 현행처럼 거래된다"며 "이를 달리 규율할 계획이 없음을 알려드린다"고 말했다. 마지막으로 "향후 필요시 당국의 입장을 일관되고 신속하게 업계와 공유할 수 있도록 긴밀한 연락 체계를 유지할 것"이라고 덧붙였다.

2024년 1월 10일 미국 SEC(증권거래위원회)는 비트코인 현물 ETP(상장지수상품)의 상장과 거래를 승인했다. ETF는 ETF, ETN(상장지수증권) 등 각종 지수나 자산을 주식처럼 거래할 수 있는 상품이다.

 

비트코인 현물 ETF가 승인된 바로 다음 날인 2024년 1월 11일 미국 증시에서는 비트코인 현물 ETF 거래가 시작됐다. 이날 증시에 상장한 비트코인 현물 ETF는 블랙록의 아이셰어스 비트코인 트러스트(IBIT.O), 그레이 스케일 비트코인 트러스트, 발키리 비트코인 펀드(BRRR.O), 아크 21셰어스 비트코인 ETF(ARKB.Z) 등 총 11개다. 이에 국내에서도 비트코인 현물 ETF가 승인되는 것이 아니냐는 기대감이 나왔다. 국내법상 비트코인 등 가상자산은 금융자산으로 인정되지 않는다. 정부는 금융기관의 가상자산 보유,매입,담보 취득,지분투자 등을 금지하고 있다.

The Financial Services Commission said on January 15, 2024 that issuing Bitcoin spot ETFs or brokering foreign Bitcoin spot ETFs could violate existing government positions and capital market laws. The U.S. approved spot ETF transactions, but it is difficult to apply them in Korea. The Financial Services Commission stressed, "This issue is directly related to the stability of the financial market, the soundness of financial companies, and the protection of investors." However, it said it has no plans to regulate overseas bitcoin futures ETFs. "Overseas bitcoin futures ETFs are traded as they are now," the Financial Services Commission said, "We inform you that we have no plans to regulate them otherwise." Finally, he added, "We will maintain a close contact system so that the authorities can share their positions with the industry consistently and quickly if necessary in the future." On January 10, 2024, the U.S. Securities and Exchange Commission (Securities and Exchange Commission) approved the listing and trading of Bitcoin spot ETP (listed products). ETFs are products that can trade various indexes or assets such as ETFs and ETN (listed securities) like stocks.

 

Bitcoin spot ETF transactions began on the U.S. stock market on Jan. 11, 2024, a day after the Bitcoin spot ETF was approved. There are a total of 11 Bitcoin spot ETFs listed on the stock market, including BlackRock's iShares Bitcoin Trust (IBIT.O), Gray Scale Bitcoin Trust, Valkyrie Bitcoin Fund (BRRR.O), and Ark 21Shares Bitcoin ETF (ARKB.Z). As a result, there were expectations that the Bitcoin spot ETF would be approved in Korea as well. Under domestic law, virtual assets such as Bitcoin are not recognized as financial assets. The government prohibits financial institutions from holding virtual assets, purchasing, acquiring collateral, and investing in equity.
