금융위원회는 다음 달 2024년 6월 19일부터 시행되는 '가상자산이용자보호법'의 세부 사항을 규율하는 가상자산이용자보호법 시행령 제정안이 최근 국무회의에서 의결됐다고 밝혔다. 법률은 현행 특정금융정보법과 동일하게 가상자산을 '경제적 가치를 지닌 것으로서 전자적으로 거래 또는 이전될 수 있는 전자적 증표'로 정의했다. 시행령에서는 전자채권, 모바일상품권뿐만 아니라 예금토큰, 대체불가능토큰(NFT)을 가상자산의 범위에서 제외되는 대상에 추가했다.

 

금융위는 가상자산 정책 및 제도에 관한 사항 자문을 위해 금융위 부위원장을 위원장으로 하는 가상자산위원회를 설치한다. 이용자의 예치금은 공신력 있는 은행에 보관하고 안전자산에 운용해야 한다. 가상자산사업자가 파산하거나 사업자 신고가 말소된 경우에는 은행이 지급 시기&장소 등을 일간신문과 홈페이지에 공고하고 이용자에게 예치금을 직접 지급하도록 했다. 가상자산사업자는 이용자 가상자산 중 70% 이상의 범위에서 금융위원회가 정하는 비율(80%) 이상의 이용자 가상자산을 인터넷과 분리해 보관해야 한다.

The Financial Services Commission said that the enactment of the Enforcement Decree of the Virtual Asset User Protection Act, which governs the details of the Virtual Asset User Protection Act, which takes effect on June 19, 2024, was recently decided at a Cabinet meeting. The law defined virtual assets as "electronic certificates that can be transferred or transferred electronically as having economic value," the same as the current specific financial information law. The enforcement decree added not only electronic bonds and mobile gift certificates, but also deposit tokens and non-fungible tokens (NFTs) to be excluded from the scope of virtual assets.

 

The Financial Services Commission establishes a virtual asset committee headed by the vice-chairman of the Financial Services Commission to advise on matters related to virtual asset policies and systems. The user's deposit shall be kept in a bank with public confidence and managed as a safe asset. In the event that the virtual asset business operator is bankrupt or the business report is canceled, the bank notifies the timing and location of payment on the daily newspaper and website, and has the user pay the deposit directly. Virtual asset business operators must store user virtual assets that are at least 70% of the user's virtual assets, and at least 80% of the user's virtual assets determined by the Financial Services Commission, separated from the Internet.
