지난달 시행된 가상자산 이용자보호법은 가상자산을 경제적 가치를 지니고 전자적으로 거래 가능한 전자적 증표로 정의했다. 이용자보호법은 가상자산 정의와 함께 예외 조항도 명시했는데 그 중 대표적으로 화폐,재화,용역 등으로 교환될 수 없는 전자적 증표나 게임물 이용을 통해 획득한 유&무형의 결과물이 가상자산에서 제외된다고 규정하고 있다. 가상자산이 화폐,재화,용역 등으로 교환돼야 한다는 의미는 화폐,금,부동산 등을 포함해 기초 자산으로 교환할 수 있어야 한다는 뜻이다. 대표적인 예로 법정화폐를 기초로 발행되는 스테이블코인이 있다.

 

그러나 이용자보호법이 가상자산의 정의를 포괄적으로 규정하고 예외 사항만 열거하면서 어떤 자산이 ‘가상자산’에 해당하는지 판단하기 모호해졌다. 실제로 법에서 가상자산의 경제적 가치를 어떻게 판단할 것인지에 대한 명확한 기준은 다뤄지지 않았다. 최근 인기를 끌고 있는 밈코인의 경제적 가치는 어떻게 판단할 수 있을까? 밈코인은 주로 인터넷 밈이나 트렌드에서 영감을 받아 만들어지며 대부분 재미를 기반으로 발행된다. 이는 유틸리티 토큰도 마찬가지다. 유틸리티 토큰은 특정 플랫폼 내에서 기능적 목적으로 사용되지만 거래소에 상장되면 경제적 가치를 지니게 된다. 결국 해당 토큰을 가상자산으로 간주할지는 상장 여부에 따라 결정될 가능성도 생기는 것이다.

The Virtual Asset User Protection Act, which took effect last month, defined virtual assets as electronic certificates that can be traded electronically with economic value. Along with the definition of virtual assets, the User Protection Act also specified exceptions, and among them, tangible and intangible results obtained through the use of electronic certificates or games that cannot be exchanged for money, goods, or services are excluded from virtual assets. The meaning that virtual assets should be exchanged for money, goods, services, etc. means that they should be able to be exchanged for underlying assets, including money, gold, and real estate. A typical example is stablecoins issued based on legal currency.

 

However, as the User Protection Act comprehensively stipulates the definition of virtual assets and lists only exceptions, it has become ambiguous to determine which assets correspond to 'virtual assets'. In fact, the law has not dealt with clear criteria for how to judge the economic value of a virtual asset. How can I judge the economic value of meme coins that have become popular recently? Meme coins are mainly created by internet memes or trends and are mostly issued based on fun. The same goes for utility tokens. Utility tokens are used for functional purposes within certain platforms, but they have economic value when they are listed on the exchange. Eventually, there is a possibility that whether or not the token is considered a virtual asset will be determined by whether or not it is listed.
